Hunkemöller Member Programme Terms and Conditions
1. Definitions
Capitalized terms used hereafter have the following meanings:
- Hunkemöller: The private company with limited liability Hunkemöller B.V. including its affiliated companies, Hunkemöller B.V., Koos Postemalaan 8, 1217 ZC Hilversum, The Netherlands;
- Member Card: The (digital) card issued by Hunkemöller as part of the Member programme;
- Hunkemöller Member: The holder of the Member (digital) card;
- Member Programme: The loyalty programme developed by Hunkemöller in which Hunkemöller customers enjoy benefits such as gift with purchase, Member only discounts, exclusive invites to events, personalized offers amongst other things;
- Member Card Customer Service: Customer service for the loyalty programme.
- (online) store(s): Customer service set up for the programme; Hunkemöller stores and web shop in The Netherlands, Germany, France, Belgium, Spain, Luxembourg, Switzerland, Austria, Norway, Sweden, Denmark, United Kingdom, Poland, Czech Republic, Finland, Italy, Portugal, Slovenia
2. Applicability
These General Terms and Conditions apply to (the application and/or use of the Member Card in the context of) the Member programme of Hunkemöller. The Member programme of Hunkemöller is offered by web shops and stores in the following countries: The Netherlands, Germany, France, Belgium, Spain, Luxembourg, Switzerland, Austria, Norway, Sweden, Denmark, United Kingdom, Poland, Czech Republic, Finland, Italy, Portugal, Slovenia.
3. Purchase and Activation of Member Card
3.1 Registration in the store
A customer can sign up to become a Hunkemöller Member in store. With the registration in store, the Hunkemöller Member automatically agrees to these terms and Hunkemöller's Privacy Statement. The Member Card is a digital card in the form of a QR code, which allows the customer to identify themselves in-store through the Hunkemöller app or at the bottom of all Hunkemöller email (newsletters). After the Hunkemöller Member has registered in store, they can complete their registration online by creating a password, the Hunkemöller Member will instantly be able to earn Passion Points and take advantage of the benefits of the Member programme. Joining Hunkemöller's Member programme is free of charge. Hunkemöller will be charging 1 EURO for a physical card. [DE ONLY]
3.2 Registration via the website/app
It is also possible to become a Hunkemöller Member via the website or app. The minimum data requirements are first name, last name, email address and birthday. When signing up for the Hunkemöller Member programme, customers automatically agree to the Hunkemöller Member programme Terms and Conditions and Privacy Statement. The Hunkemöller Member will instantly be able to save Passion Points and take advantage of the benefits of the Member programme. There is no membership fee for joining Hunkemöller's Member programme.
3.3 Advantages
The Hunkemöller Member receives various benefits by registering for the Member Card. By saving Passion Points, the Hunkemöller Member falls within a predefined level (see 5. Savings system). Within this level, the Hunkemöller Member is entitled to various benefits (see 5. Savings system). The Hunkemöller Member is also entitled to (discount) vouchers which they can redeem via the website, app or in-store. The Hunkemöller Member receives special invitations to Hunkemöller Member events, personalized suggestions and advice, provided that the member has subscribed to receive marketing communications.
3.4 Participation in the Member Programme
Participation in the Member Programme is only possible if a customer has a valid residential address in The Netherlands, Germany, France, Belgium, Spain, Luxembourg, Switzerland, Austria, Norway, Sweden, Denmark, United Kingdom, Poland, Czech Republic, Finland, Italy, Portugal, Slovenia.
3.5 Minimum age
Participation in the Member Programme is possible from 12 years of age and older. The Hunkemöller Member must be at least 16 years old to make an online purchase. Hunkemöller Members under 16 years old can make a purchase in the physical store.
4. Use
The Hunkemöller Member can make use of their Member Card after registration. The Member Card is strictly personal and non-transferable. The Member Card remains the property of Hunkemöller. Only 1 (one) email address per Member Card is possible and a maximum of 1 (one) Member Card can be used per customer.
5. Savings System
5.1 Passion Points
A valid Member Card allows the Hunkemöller Member to earn Passion Points. The different ways of saving are communicated to the Hunkemöller Member via the website and the app. The Hunkemöller Member can earn Passion Points in various ways:
- By making a purchase; every ten euro cent (€0.10) spent is worth one Passion Point;
- By completing personal data, so that Hunkemöller can personalize the communication to a customer, and for analysis purposes. These fields are not mandatory. The Hunkemöller Member receives a one-off reward of 25 Passion Points for each completed field: Telephone number, gender, bra size, brief size, 1 of 2 Sexy Shapes, 1 of 4 Favourite Fits and Interests. A customer can earn up to 200 Passion Points with this data.
- By completing personal interests, so that Hunkemöller can personalize the communication to the customer, and for aggregated analysis purposes. The fields are not mandatory. The Hunkemöller Member receives 25 Passion Points in total as a one-off award upon indicating their interests. These interests are sport, travel, health, beauty, culture and fashion. These interests are included in the aforementioned 200 Passion Points a Member can earn.
All purchases from the store, website and app count towards a total spend (except for the use of shop credit, discount vouchers and the shipping costs of online orders). These purchases can only be tracked on presentation of a valid Member Card.
If the Hunkemöller Member returns a purchase (on presentation of the receipt in stores), the Passion Points accrued due to the purchase will also be deducted from the account.
Passion Points can never be converted into money. Passion Points remain valid for as long as the Hunkemöller Member continues to actively participate in the Member programme. The Hunkemöller Member can lose some of their Passion Points after one year of Membership (see 5.1.1 Drop down after each Membership year). The Hunkemöller Member will lose all of their Passion Points when inactive for one year (see 9. Inactivity).
5.1.1 Drop down after each Membership year
After one year of Membership has passed (each year on the date the Member has registered), the Hunkemöller Member will drop back to the start of the level they are in or to the end of the previous level, based on the number of Passion Points earned.
To stay in level 2, a minimum of 900 Passion Points earned in one Member year is required.
In case the Hunkemöller Member in level 2 has earned <900 Passion Points in one Member year, the Member will drop back to level 1 at 999 Passion Points.
In case the Hunkemöller Member in level 2 has earned >900 Passion Points in one Member year, the Member will drop back to the start of level 2 at 1000 Passion Points.
To stay in level 3 - VIP, a minimum of 2000 Passion Points earned in one Member year is required.
In case the Hunkemöller Member in level 3 - VIP has earned <2000 Passion Points in one Member year, the Member will drop back to level 2 at 1999 Passion Points
Member Programme Terms and Conditions
5.1 Passion Points
To stay in level 3 - VIP, a minimum of 2000 Passion Points earned in one Member year is required.
In case the Hunkemöller Member in level 3 - VIP has earned <2000 Passion Points in one Member year, the Member will drop back to level 2 at 1999 Passion Points.
In case the Hunkemöller Member in level 3 has earned >2000 Passion Points in one Member year, the Member will drop back to the start of level 3 at 2000 Passion Points.
5.2 Member Levels
When a Hunkemöller customer becomes a Member of the Member Programme, they are allocated to a certain level which is linked to the number of Passion Points the customer has accumulated. The Member programme has 3 levels:
- Level 1: Passion Point total from 0 to 999
- Level 2: Passion Point total from 1000 to 1999
- Level 3-VIP: Passion Point total from 2000 to 5000
On each level the Member is entitled to certain benefits (see 5.3 Set benefits).
Members could move up or down these levels by, but this might vary and can be changed by Hunkemöller at any time:
- Making purchases or other activities (see 5.1 Passion Points)
- Returning purchases (see 5.1 Passion Points)
- Inactivity in the programme (see 9. Inactivity)
- Not earning the minimum required Passion Points to remain in their current level, after one year of Membership
- Winning Passion Points in the Wheel of Passion game
- Swapping Passion Points for certain benefits
Members will be alerted to this by newsletters from Hunkemöller, provided that they are subscribed to receive the Hunkemöller newsletter. A new Hunkemöller Member starts in level 1.
5.3 Member Benefits
In each level, as described in 5.2 Member levels, the Member has access to benefits. These benefits can vary over time and can be changed by Hunkemöller at any moment. Some of these benefits are loaded on Member accounts in the shape of a voucher, which can be used online (web/app) and in stores. This may vary per offer.
Example of benefits:
- Member only promotions;
- Welcome discount 10%;
- Gift with purchase;
- Free Shipping;
- Birthday gift;
- Early access to promotions or new collections;
- Exclusive invites to events;
- Personalized discounts; or
- Win competitions.
When a Hunkemöller Member drops in level, they are no longer entitled to the benefits of the level above.
5.4 Vouchers
Each Hunkemöller Member may receive vouchers. These vouchers are loaded to the Member account based on the then current Passion Points balance or your purchases. The Member can use a voucher by selecting it in the shopping cart on the website and in the app, or at the checkout in the store. In addition, there are different types of vouchers which are discussed in the subsections below. The validity of the voucher is not known beforehand and can be different per voucher. The expiration date is visible in the terms and conditions of the voucher itself. Vouchers are not valid in our Designer Outlet Centres (DOC) stores.
5.4.1 Discount Vouchers
Each Hunkemöller Member may receive discount vouchers. These discount vouchers can be linked to a specific campaign, the Wheel of Passion or to moving through the levels of the programme. The voucher will give a percentage discount on certain product categories or a discount on certain products.
5.4.2 Personalized Vouchers
Each Hunkemöller Member may also receive personalized vouchers. These vouchers are awarded to the Hunkemöller Member based on various criteria, for example the level of the Hunkemöller Member or the Member’s purchase history.
5.4.3 Swap Passion Points for Benefits
Hunkemöller Members can swap Passion Points to unlock different benefits, often in the shape of a voucher. These can be different discounts, vouchers to participate in a win competition, or to receive a discount with one of our partners, a gift, free shipping and other options. In the event of a full return, a Hunkemöller Member will receive a refund for the discount or shop credit and a refund for the Passion Points spent. If a Member makes a partial return, the money spent on the order will be returned with the discount used applied over all products. However, the voucher and the Passion Points spent on the order are not returned. The vouchers or shop credit are not valid in our Designer Outlet Centres (DOC) stores.
5.4.4 Gift Vouchers
Hunkemöller Members from time to time will receive the benefit of a gift with their purchase (in the shape of a voucher) on their account. The gifts will vary and change during the year. As for all vouchers, also the voucher for a gift will have an expiration date that will be indicated in the terms listed in the voucher itself.
5.4.5 Grand Prize at 5000 Passion Points
Members in level 3 - VIP, will get a grand prize at the end of that level when 5000 Passion Points have been reached. The prize can be redeemed by applying the voucher loaded on the Member account, in a transaction in store or online on the website or in the App. The prize and its validity will vary and change over time. The prize cannot be converted into money. In case of a full return, the Hunkemöller Member will receive a refund for the discount and depending on whether the expiration date has passed, the voucher will or will not be reloaded back on the Member account. In case of a partial return, the money spent on the transaction will be returned with the discount used applied over all products. However, the voucher will not be returned. The vouchers or shop credit are not valid in our Designer Outlet Centres (DOC) stores.
6. Shop Credit
It could be a possibility that a Hunkemöller Member earns shop credit. Shop credit can be loaded on Member accounts on different moments, occasions and undefined frequency per year. Each shop credit amount can have a different expiration date. The shop credit can be used with any purchase and in combination with vouchers. The Member can use the shop credit through the shopping cart on the website and in the app, or at the checkout in the store. This shop credit will be deducted from the Member account after using it in a purchase.
7. Other Benefits
Next to the vouchers and shop credit described above, there are other benefits a Hunkemöller Member could be rewarded with. These benefits could be available on a Member account through a voucher, but could also be in a different way, such as via a game or on the Hunkemöller App.
7.1 Events
Hunkemöller may organize events for which Members could receive an invite. The Hunkemöller Member can register for an event, have a chance to sign up first or participate in a win competition. This may take place by activating a voucher or in a different way via our website, App or in stores. The Hunkemöller Member will then receive a verification/ticket by email.
7.2 Gifts
The Hunkemöller Member may also receive Gift vouchers, entitling them to a gift with purchase. Terms & Conditions to receive this gift are listed in the voucher information in section 5.4.4 Gift vouchers.
7.3 Services
Hunkemöller may offer certain services. Services can differ and will not always be available. When a certain service is offered, this service will be made available to the Hunkemöller Member on their account, sometimes via a voucher.
7.4 Win Competitions
The Hunkemöller Member can participate in certain Win competitions. Win competitions can be offered in different ways, through the app, via the use of a voucher or via our social channels.
7.5 Wheel of Passion
A registered Hunkemöller Member can participate in playing the 'Wheel of Passion', hereafter called the 'game'. The Hunkemöller Member can play the game via the website (in the Member account) or the app. This functionality is not available at all times and is turned on or off by Hunkemöller for certain periods. In the game, a Hunkemöller Member can win Passion Points and other prizes by spinning the wheel. 8. Student Discount
A registered Hunkemöller Member can get a student discount at Hunkemöller. This discount is organized by Hunkemöller. On presentation of a valid student card in-store, the Hunkemöller Member receives a 10% discount in store. This discount is valid in combination with other actions and/or promotions. The discount is only valid for purchases in-store, and is not valid online or via the app.
9. Changes
Hunkemöller reserves the right to withdraw, change or make new offers for the Member programme and Passion Points as described herein at any time and under any circumstances. Hunkemöller Members will be informed about changes via email or on the website of www.hunkemoller.nl. If a Hunkemöller Member wishes to change, add to or delete data that is known to Hunkemöller in the context of the Member programme, they can do so by filling in and sending this form. If the Hunkemöller Member deletes all personal data, it will not be possible to take advantage of the benefits of the Member programme.
10. Inactivity and Termination of Participation
10.1 Active Member and Lapse of Passion Points
Looking at a Membership year, starting on the original registration date, a Member should have earned a minimum of Passion Points to remain in their current level.
Level 1
When in level 1, after a Member year, their Passion Points balance will be reset to zero and Member will drop to the start of level 1.
Level 2
When in level 2, a Member should have earned a minimum of 900 Passion Points in their Member year, to stay in level 2. At the start of their new Member year, the Member will drop back to the start of level 2, at 1000 Passion Points.
In case the Member earned less than 900 Passion Points in the past Member year, the Member will drop back to level 1, at 999 Passion Points.
Level 3 - VIP
When in level 3 - VIP, a Member should have earned a minimum of 2000 Passion Points in their Member year, to stay in level 3 - VIP. At the start of their new Member year, the Member will drop back to the start of level 3 - VIP, at 2000 Passion Points.
In case the Member earned less than 2000 Passion Points in the past Member year, the Member will drop back to level 2, at 1999 Passion Points.
10.2 Inactivity and Lapse of Passion Points
When a Hunkemöller Member has not made a purchase in the last year (the last 12 months), the Member will fall back to the start of level 1, at zero Passion Points. The Member will lose all benefits connected to the level they were in before (e.g. level 2).
10.3 Cancellation of Participation by Hunkemöller
If you are inactive as a Member due to not using your Member Card for six (6) years, we will send you an e-mail asking whether you still wish to be a Member. If you remain inactive thereafter, we will cancel your Membership and delete your personal data related to your Membership. If, after this 6 year period, the Hunkemöller Member still decides to make a purchase from Hunkemöller, the Hunkemöller Member can create a new Member account in stores, on the website or in the App.
10.4 Cancellation of Participation by Member
Hunkemöller Members can cancel their participation in the Member programme at any time. To cancel participation in the Member programme, the Hunkemöller Member should fill in and send this form and confirm cancellation via the received email. This form can also be found via the "Delete" button in the App. The cancellation process can take up to 1 month, until this time the account of the customer remains in the system. After cancellation, the Member Card is no longer valid. After termination, the Member Card cannot be used to benefit from the advantages of the Member programme. Any Shop Credit or other rewards and benefits remaining after cancellation will expire and cannot be converted to cash.
11. Abuse of the Programme
Hunkemöller has the right, without prejudice to all its rights, in case of fraud, the provision of incomplete or incorrect information, in case of breach of these General Terms and Conditions, abuse of rights as a Hunkemöller Member or any other action causing damage to Hunkemöller and/or its stores, to withdraw the Member Card with immediate effect, to block it and/or to withdraw any saved discount and/or to cancel any purchase made in this way. The same applies when a Hunkemöller Member changes, falsifies, subverts or damages the Member Card in any other way (including hacking), or attempts to do so. Fraud (or attempted fraud) or any other unauthorized action may be recorded and may result in the Hunkemöller Member being denied the use of the Member Card.
12. Termination of Programme
Hunkemöller reserves the right to terminate the Member programme at any time. The Hunkemöller Member will be informed of the termination no later than 3 (three) months in advance. Until the date of termination, the Hunkemöller Member can continue to enjoy the current benefits of the Member programme. After termination under this section, the Hunkemöller Member will not be able to enjoy the current benefits of the Member Programme.
13. Lost, Stolen or Defective Member Card
In case of loss, theft or malfunction of the Member Card, a Hunkemöller Member must inform Hunkemöller as soon as possible. The Member Card will then be blocked and Hunkemöller will send them a new Member Card as soon as possible. To receive a new Member Card, call +31 (0) 35 6465412 (customer service in Hilversum) or visit a Hunkemöller store. The Passion Point total of the Member Card and any vouchers are then transferred to the new Member Card.
Until receiving the new Member Card, a Hunkemöller Member can use the advantages of the Member programme by logging in via the website or app. In addition, store staff can look up the Hunkemöller Member via the checkout upon presentation of a valid ID. If a third-party gains unauthorized (digital or physical) access to the Member Card and/or login data, this is at the risk of the Hunkemöller Member.
14. Privacy
Under the Member programme, personal data is processed from the Hunkemöller Member, including the personal data provided by the Hunkemöller Member during the registration process in-store, online or via the app. Hunkemöller is committed to protecting all personal data. Read our Privacy Statement for more information about the personal data Hunkemöller processes and how personal data is used in relation to the Member programme
15. Liability
Hunkemöller is not liable for unauthorized use - by the Hunkemöller Member or by third parties - of the Member Card, nor for the fraudulent use of a discount or shop credit. Hunkemöller is not liable for theft (including the use of the Hunkemöller Member's login by unauthorized third parties), loss, counterfeiting or misuse of the Member Card. Hunkemöller will not refund any outstanding shop credit under any circumstances.
16. Other Provisions
Hunkemöller reserves the right to change these General Terms and Conditions. On the date the amended conditions come into force, all previous General Terms and Conditions will expire. Dutch law applies to these General Terms and Conditions and the Member programme. Any disputes may be submitted exclusively to the competent court in Amsterdam.
