Hunkemöller Member Card Terms and Conditions           

1. Definitions     

Capitalized terms used hereafter have the following meanings:   

Hunkemöller:

The private company with limited liability Hunkemöller B.V. including its affiliated companies, Hunkemöller B.V., Liebergerweg 28, (1221 JS) in Hilversum;

Member Card:

The card issued by Hunkemöller as part of the Member Card programme;

Hunkemöller Member:

The holder of the Member Card;

Member Card Programme:

The loyalty programme developed by Hunkemöller in which Hunkemöller customers can save for a discount by using a Member Card, amongst other things;

Member Card Customer Service:

Customer service for the loyalty program.

(online) store(s):

Customer service set up for the programme; Hunkemöller stores and web shop in Austria, Belgium, Czech Republic, Croatia, Denmark, Finland, France, Germany, Italy, Luxembourg, the Netherlands, Norway, Poland, Portugal, Slovenia, Spain, Sweden, Switzerland and the United Kingdom.

 

2. Applicability  

These General Terms and Conditions apply to (the application and/or use of the Member Card in the context of) the Member Card programme of Hunkemöller. The Member Card programme of Hunkemöller is offered by web shops and stores in the following countries: Austria, Belgium, Denmark, Finland, France, Germany, Italy, Croatia, Luxembourg, the Netherlands, Norway, Poland, Portugal, Slovenia, Spain, Czech Republic, Switzerland, Sweden and the United Kingdom.    

3. Purchase and Activation of Member Card        

1. Registration in the store          

Once a Hunkemöller Member has received a card in-store and has registered it via the checkout, they will receive an email to activate their profile. Until then, the card status remains "pending". The customer will then be able to save points, but will not be able to enjoy the benefits of the savings programme. By clicking on the link in the email, the customer's email address is verified and the customer must complete their registration via the website. The minimum data requirements of the customer are; first name, last name and e-mail address. The customer must also create a password via the website and agree to these terms and Hunkemöller's Privacy Statement. There is no membership fee for jouning Hunkemöller's Member Card programme. The customer can receive a physical card or opt for a digital card in the form of a QR code, which allows the customer to identify themselves in-store through the Hunkemöller app or wallet.       

2. Registration via the website/app         

It is also possible to become a Hunkemöller member via the website or app. The minimum data requirements are first name, last name, email address and password. Customers must also agree to Hunkemöller's Terms and Conditions and Privacy Statement. When a Hunkemöller Member registers online or via the app, they receive an email to confirm the registration and verify the email address. Until then, the card status remains "pending". The customer will then be able to save points, but will not be able to take advantage of the benefits of the savings programme. Clicking on the link in the e-mail will complete the registration. There is no membership fee for joining Hunkemöller's Member Card programme.    

3. Advantages   

The Hunkemöller Member receives various benefits by registering for the Member Card. By saving Passion Points, the Hunkemöller Member falls within a predefined level (see 5. savings system). Within this level, the Hunkemöller Member is entitled to various predefined benefits (see 5. savings system). The Hunkemöller Member is also entitled to (discount) vouchers which they can redeem via the website, app or in-store. By scanning the Member Card or logging in to the account of the Hunkemöller Member, the vouchers become available during the payment transaction. The Hunkemöller Member also receives special invitations to Hunkemöller Member events, receives exclusive mailings (with permission), personalised suggestions and advice. 

4. Participation in the Member Card Programme              

Participation in the Member Card Programme is only possible if a customer has a valid residential address in Austria, Belgium, Czech Republic, Denmark, Finland, France, Germany, Italy, Croatia, Luxembourg, the Netherlands, Norway, Poland, Portugal, Slovenia, Spain, Sweden and the United Kingdom.             

5. Minimum age              

Participation in the Member Card Programme is possible from 12 years of age and older. The Hunkemöller Member must be at least 16 years old to make an online purchase. Hunkemöller Members under 16 years old can make a purchase in the physical store. Newsletters are also only sent to Members aged 16 years or older.            

 

4. Use   

The Hunkemöller Member can make use of their Member Card after registration by completing the application form as mentioned in 3, and after the purchase and activation of the Member Card. The Member Card is strictly personal and non-transferable. The Member Card remains the property of Hunkemöller. Only 1 (one) email address per card is possible and a maximum of 1 (one) Member Card can be used per customer.        

              

5. Savings System            

5.1 Passion Points           

A valid Member Card allows the Hunkemöller Member to earn Passion Points. The different ways of saving are communicated to the Hunkemöller Member via the website and the app. The Hunkemöller Member can earn Passion Points in various ways:  

By making a purchase; every ten euro cent (€0.10) spent is worth one Passion Point;    

By completing personal data, so that Hunkemöller can personalize the communication to a customer, and for analysis purposes. These fields are not mandatory. The Hunkemöller Member receives a one-off award of 25 Passion Points for each completed field: telephone number, gender, date of birth, home address, bra size, top and brief size, 1 of 2 Sexy Shapes, 1 of 4 Favourite Fits. A customer can earn up to 200 Passion Points with this data.     

By completing personal interests, so that Hunkemöller can personalize the communication to the customer, and for analysis purposes. The fields are not mandatory. The Hunkemöller Member receives a one-time award of 25 Passion Points for a minimum of 1 and a maximum of 6 interests. These interests are sport, travel, health, beauty, culture and fashion.   

By accomplishing missions and earning badges. In total there are 11 types of badges that a Hunkemöller Member can earn. For example, once a customer has made a purchase in the store, via the website and the app, the customer receives a badge and 250 Passion Points.   

By means of bonus Passion Points rules which Hunkemöller sets on a campaign basis for customers. For example, double Passion Points are awarded on Member Day. The Hunkemöller Member is informed in advance of these campaigns via the website, app or newsletter. 

All purchases from the store, website and app count towards a total spend (except for the purchase of Hunkemöller gift vouchers and the shipping costs of online orders). These purchases can only be tracked on presentation of a valid Member Card.    

If the Hunkemöller Member returns a purchase (on presentation of the receipt), the Passion Points accrued will also be deducted.           

Passion Points can never be converted into money. Passion Points remain valid for as long as the Hunkemöller Member continues to actively participate in the Member Card programme. The Hunkemöller Member can lose Passion Points through inactivity, see 9. Inactivity for more information.      

5.2 Member Levels         

When a Hunkemöller Member becomes a member of the Member Card Programme, they are allocated to a certain level which is linked to the number of Passion Points the customer has accumulated. The programme has 4 levels:       

Level 1 (Flirty Fun): point total from 0 to 499       

Level 2 (Secret Crush): point total from 500 to 999           

Level 3 (Hot Match): point total from 1000 to 1999          

Level 4 (True Love): point total of more than 2000            

On this level the Member is entitled to certain fixed benefits, see 5.3 set benefits.             

Members can move up or down these levels by: 

making purchases or other activities (see 5.1 Passion Points)       

returning purchases (see 5.1 Passion Points)       

inactivity in the programme (see 9. Inactivity)     

Members will be alerted to this by newsletters from Hunkemöller (provided permission is given). A new Hunkemöller Member starts in the lowest level. All existing Members of the old programme receive a welcome bonus of 500 Passion Points, which starts them on level 2.

5.3 Fixed benefits           

Each level, as described in 5.2 Member levels, has predefined benefits. These benefits are listed on the website and in Hunkemöller's app. The higher the level, the more exclusive the benefits.

When a Hunkemöller Member drops in level, they are no longer entitled to the benefits of the level above.  

5.4 Personal vouchers    

Each Hunkemöller Member is entitled to receive personal vouchers. These vouchers are awarded to the Hunkemöller Member based on various criteria, such as the level of the Hunkemöller Member or the Member's shopping behaviour. The higher the Member level, the more exclusive the vouchers are. In addition, there are different types of vouchers which are discussed in the subsections below.

5.4.1 Shopping vouchers             

The Member Card programme has several set points at which a Hunkemöller Member can earn a shopping voucher. This is when a Hunkemöller Member has earned a balance of 250, 500, 750, 1000, 1250 and 1500 points. The Hunkemöller Member can earn up to 6 of these types of vouchers. When a Hunkemöller Member returns their purchase they are entitled to a new voucher at the next set time. For example, a Hunkemöller Member has made a purchase and as a result receives 550 points. The Hunkemöller Member then receives their second Shopping Voucher. The Hunkemöller Member returns their purchase and the points total falls to 300 points. At that stage, the Hunkemöller Member is entitled to a new store credit voucher on their next purchase, provided they reach a balance of at least 500 points.    

In addition, the shopping vouchers are valid for 3 months. The customer can use the voucher through the shopping cart on the website and in the app, or at the checkout in the store. It is possible to use several of these vouchers for one transaction. They can also be combined with other actions or promotions.  

5.4.2 Redeeming Vouchers for Points      

In the final (fourth) level, a Hunkemöller Member can use points to 'buy' a voucher. These can be different types of vouchers, such as a shopping voucher, or another discount voucher such as free shipping. The Hunkemöller Member can purchase the voucher in the shopping basket on the website and in the app, or at the checkout in-store. This type of voucher is only shown when the customer has enough points to 'buy' the voucher. This means that a Hunkemöller Member cannot downgrade to a lower level. These vouchers have a different validity to that shown in the terms and conditions of the specific voucher. In the event of a return, a Hunkemöller Member will not receive a refund for the voucher but will receive a refund for the points spent. These vouchers are not valid in our Designer Outlet Centers (DOC) stores.    

5.4.3 Surprise Vouchers 

Members can also use surprise vouchers in the programme. This type of voucher is allocated by Hunkemöller to a Hunkemöller Member and is not visible beforehand on their account. The validity of the voucher is also not known beforehand and is visible in the terms and conditions of the voucher itself. The Hunkemöller Member is informed of the availability of vouchers via the newsletter or the app. These vouchers are not valid in our Designer Outlet Centers (DOC) stores.

Special occasions            

Hunkemöller Members receive a surprise voucher on certain special occasions such as their birthday or a certain anniversary, if the Hunkemöller Member has been a member of the Member programme for a certain number of years. This can be a discount or a gift that the Member can pick up in-store. The vouchers are only shown when the Member is in a certain level, for example, only valid for level 4 Members. These surprise vouchers can appear in any level.             

Events  

Hunkemöller also organises certain events for Members. The Hunkemöller Member can register for an event by activating a voucher. The Hunkemöller Member then receives a verification/ticket by email.           

Gifts      

The Hunkemöller Member also receives vouchers entitling them to a gift with a purchase. For example, for the purchase of a minimum of €50 in sporting goods, the Hunkemöller Member will receive a sporting voucher.              

Services              

Hunkemöller also organizes certain services, such as having an item purchased by a Hunkemöller member embroidered. This could be, for example, during the Valentine's Day campaign. The Hunkemöller Member will then have a voucher available on their account which they can activate to be entitled to this service.      

Contests             

The Hunkemöller Member can participate in certain contests by activating a voucher via the website or app. Hunkemöller will choose winners through a draw or a certain contest that a Hunkemöller Member can enter.          

 

6. Wheel of Passion        

A registered Hunkemöller Member can participate in playing the 'Wheel of Passion', hereafter called the 'game'. The Hunkemöller Member can play the game via the website (in the account) or the app. This functionality is not available at all times and is turned on or off by Hunkemöller for a certain period. In the game, a Hunkemöller Member can win Passion Points and other prizes by spinning the wheel. The full terms and conditions of the game can be found at www.hunkemoller.nl/wheelofpassion.      

 

7. Friends discount programme 

A registered Hunkemöller Member can participate in Hunkemöller's friends' advantage programme, in association with our external supplier, Buyapowa Limited. This means that Member can earn Passion Points if they refer friends and/or family to Hunkemöller. In addition, the new customer receives a discount on their first purchase from Hunkemöller. This advantages programme is currently only available in the Netherlands. A customer can only participate if they are 16 years or older. 8. Student discount        

A registered Hunkemöller Member can get a student discount at Hunkemöller. This discount is organized by Hunkemöller. On presentation of a valid student card, the Hunkemöller Member receives a 10% discount in store. This discount is valid in combination with other actions and/or promotions. The discount is only valid for purchases in-store, and is not valid online or via the app.

 

9. Changes         

Hunkemöller reserves the right to withdraw, change or make new offers for the Member Card programme as described herein at any time and under any circumstances. Hunkemöller Members will be notified in advance of any changes via email or on the website www.hunkemoller.nl. If a Hunkemöller Member wishes to change, add to or delete data that is known to Hunkemöller in the context of the Member Card programme, they can do so by sending an email to customer service or privacy@hunkemoller.com. If the Hunkemöller Member deletes all personal data, it will not be possible to take advantage of the benefits of the Member Card programme.  

 

10. Inactivity and termination of participation     

10.1 Inactivity and lapse of points            

After registering a Hunkemöller Member, every year (after 365 days) we check whether the Hunkemöller Member has shown activity in the Member Card programme. This means that the Hunkemöller Member could lose the points needed to maintain their current level. For example, when a Hunkemöller Member is in level 2, they need a minimum of 500 points. This Hunkemöller Member's balance is 800 and they have not made a purchase in the last 365 days. Therefore 301 points expire and the customer drops back to level 1. When this happens in level 1, the Hunkemöller Member's points total drops back to 0.       

10.2 Cancellation of participation by Hunkemöller           

If after 6 years (each year counted from the date of registration) a Hunkemöller Member does not show any activity, the profile of the Hunkemöller Member will be archived. This means that the Hunkemöller Member's personal data will be anonymised and that the Hunkemöller Member will no longer be able to access the benefits of the Member Card programme. If, after this 6 year period, the Hunkemöller Member still decides to make a purchase from Hunkemöller, the Hunkemöller Member can purchase a new Member Card or create an account on the website or app.                    

10.3 Cancellation of participation by Member     

Hunkemöller Members can cancel their participation in the Member Card programme at any time. To cancel participation in the Member Card programme, the Hunkemöller Member should send an e-mail to privacy@hunkemoller.com. After cancellation, the Member Card is no longer valid. Any saved discount total must be used by the Hunkemöller Member for a discount on the products. After termination, the Member Card cannot be used to benefit from the advantages of the Member Card programme. Any credit total remaining after cancellation will expire and cannot be converted to cash.     

              

11. Abuse of the programme      

Hunkemöller has the right, without prejudice to all its rights, in case of fraud, the provision of incomplete or incorrect information, in case of breach of these General Terms and Conditions, abuse of rights as a Hunkemöller Member or any other action causing damage to Hunkemöller and/or its stores, to withdraw the Member Card with immediate effect, to block it and/or to withdraw any saved discount and/or to cancel any purchase made in this way. The same applies when a Hunkemöller Member changes, falsifies, subverts or damages the Member Card in any other way (including hacking), or attempts to do so. Fraud (or attempted fraud) or any other unauthorized action may be recorded and may result in the Hunkemöller Member being denied the use of the Member Card.            

              

12. Termination of programme  

Hunkemöller reserves the right to terminate the Member Card programme at any time. The Hunkemöller Member will be informed of the termination no later than 3 (three) months in advance. Until the date of termination, the Hunkemöller Member can continue to enjoy the current benefits of the Member Card programme. After termination under this section, the Hunkemöller Member will not be able to enjoy the current benefits of the Member Card Programme.         

              

13. Lost, stolen or defective Member Card           

In case of loss, theft or malfunction of the Member Card, a Hunkemöller Member must inform Hunkemöller as soon as possible. The Member Card will then be blocked and Hunkemöller will send them a new Member Card as soon as possible, free of charge. To receive a new Member Card, call +31 (0) 35 6465412 (customer service in Hilversum) or visit a Hunkemöller store. The point total of the card and any vouchers are then transferred to the new card.    

Until receiving the new Member Card, a Hunkemöller Member can use the advantages of the Member Card programme by logging in via the website or app. In addition, in-store staff can look up the Hunkemöller Member via the checkout upon presentation of a valid ID. If a third party gains unauthorized (digital or physical) access to the Member Card and/or login data, this is at the risk of the Hunkemöller Member.        

              

14. Privacy         

Under the Member Card programme, personal data is processed from the Hunkemöller Member, including the personal data provided by the Hunkemöller Member during the registration process in-store, online or via the app. Hunkemöller is committed to protecting all personal data. Read our Privacy Statement for more information about the personal data Hunkemöller processes and how personal data is used in relation to the Member Card programme and the rights of the Hunkemöller Member as a data subject.      

              

15. Liability        

Hunkemöller is not liable for unauthorized use - by the Hunkemöller Member or by third parties - of the Member Card, nor for the fraudulent use of a discount credit. Hunkemöller is not liable for theft (including the use of the Hunkemöller Member's login by unauthorized third parties), loss, counterfeiting or misuse of the Member Card. Hunkemöller will not refund any outstanding shop credit under any circumstances.     

              

16. Other provisions      

Hunkemöller reserves the right to change these General Terms and Conditions. On the date the amended conditions come into force, all previous General Terms and Conditions will expire. Dutch law applies to these General Terms and Conditions and the Member Card programme. Any disputes may be submitted exclusively to the competent court in Amsterdam.
